Introduction

Dami Strategies Sdn Bhd (including its affiliates, collectively as “we”, “our” or “us”) recognizes our responsibilities in relation to the collection, use, share, disclosure and other processing and storage of personal data in accordance with the Personal Data Protection Act 2010 (“PDPA 2010”) and other applicable regulations and guidelines. This notice clarifies how we process your personal data from the point we collect, use, share, dispose of and the security measures that we established to ensure your personal data is well protected.

Collection of Personal Data

We may collect the following personal information from you, including but not limited to:

  1. you and/ or your child’s profile information such as name, gender, race, age, date of birth, email address, mobile number and residential address, weight, height, name of school, level of education, occupation, number of children;
  2. your child’s biological sample, collected by way of saliva or buccal swab and the genetic information generated through the processing of such DNA sample by us or by our service provider or otherwise processed by and/ or contributed to us;
  3. you and/ or your child’s physical or mental health or condition voluntarily disclosed or collected in connection with your use of our Services (as defined below);
  4. your financial information such as bank account or debit/ credit details;
  5. information recorded via CCTV or other surveillance systems when you are at or near our premises;
  6. information relating to your username and password of your user account on our Website;
  7. information relating to any inquiries, feedback, or interactions with our staff, including records of calls, emails, or other communications;
  8. any other information that you have provided to us or is necessary and/or relevant for the purposes stated below.
Where the personal data relates to child below the age of eighteen (18) years, you hereby confirm that you are the parent or legal guardian of the child that you have the authority to provide consent on behalf of the child.

By submitting your personal information to us including but not limited to the information stated above, you hereby give your consent to our collection and processing of your personal data.

By signifying your consent to us, you also give us your explicit consent to process your sensitive personal data such as information relating to your and your child’s physical or mental health or condition for the purposes as described in this Policy or as required by law.

By providing us with any information relating to a third party (if any), you represent to us that you have validly obtained the consent of the third party to our collection and processing of his/ her personal data.

Source of Collection of Personal Data

We collect personal data directly from you and/or through the following means:

  1. when you visit our website https://neucleuseducation.com/ (“Website”);
  2. when you provide or update your information with us, which may include personal data you furnished when filling in enquiry forms and other similar online forms, available on or through our Website;
  3. when you interact with us directly or indirectly through various communication channels, including but not limited to telephone calls, mails, in-person or virtual meetings, emails, social medias platforms, or our Website;
  4. when you participate in or provide feedback for any of our events, surveys and/ or any interactive activities whether virtual or physical;
  5. when you engage or use our services, including but not limited to the DNA testing, personalized child development programs and parenting consultations (“Services”);
  6. when you submit to us any form, such as registrations, declarations or other relevant forms, whether online or in physical form, for the purposes including but not limited to processing your enquiries, managing your account, improving our Services, or facilitating your access to our Services;
  7. when you make payments, subscribe to our Services or update your billing and/ or payment information;
  8. when you visit or attempt access our premises and your image and/ or activities are captured through closed-circuit television (“CCTV”) or other security surveillance systems;
  9. when you communicate or otherwise interact with any of our staff in relation to your account, our Services, or any other matter connected with your dealings with us;
  10. when we receive your personal data from third-party sources, including but not limited to our business partners, collaborators, authorised representatives or any other parties who are lawfully entitled to disclose your personal data to us;
  11. when we are required to collect or process your personal data for purposes of complying with applicable laws, rules, regulations, or our internal policies or for any other purpose set out in this Policy; and/ or
  12. when we are required to collect your personal data for the Purposes (as defined below) stated below.

Reason of Personal Data Collection

Personal data shall be collected, used, shared and disclosed for one or more of the following purposes:
  1. verifying your identity and registration for the Services;
  2. providing you access to and use of the Services;
  3. facilitating any consultations or related arrangements requested by you;
  4. processing any necessary payment transactions in connection with the Services;
  5. communicating with you in relation to your account, use of the Services, or any other enquiries, feedback, or requests;
  6. keeping you informed of our announcements, promotions, events, or operational updates;
  7. ensuring security of and controlling access to the premises, platforms, or systems through which the Services are provided;
  8. complying with all applicable legislative, statutory and regulatory requirements;
  9. for purposes connected with the operation, administration, development, or enhancement of the Services; and/ or
  10. for all other purposes in relation or incidental to the above.

Processing of Personal Data

We will process your personal data in Malaysia, Singapore and the United States.

Disclosure of Personal Data

We may disclose and/or provide your personal data to the following parties (within and outside Malaysia) for the abovementioned purposes:

  1. service providers engaged by us to support DNA testing, genotyping analysis, or the administration of the Services, including any third-party laboratory operators, data processing or storage providers and IT support providers;
  2. any person, who is under a duty of confidentiality who has undertaken the responsibility to keep such information confidential;
  3. governmental and other regulatory authorities or the courts in any jurisdiction; or any third-party claimants or potential third-party claimants; and
  4. any other party in respect of the Purposes.

Security Measure

Your personal data will be kept in accordance with the PDPA 2010.

We will take all reasonable efforts to safeguard personal data in our possession or control by implementing reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks. Notwithstanding the foregoing, we do not warrant or represent that the security of any personal data collected from or about you can be guaranteed in all circumstances, nor that our website will be free from harmful code (e.g. viruses, bugs, trojan horses, spyware or adware). Nevertheless, you are required to keep your username and password secure and confidential and shall not disclose to any unauthorised party to reduce the risk of data breaches.

Personal Data Retention Period

You acknowledge that unless you request in writing or otherwise, we, in our sole discretion, to keep or retain your personal data so long as necessary to fulfil the Purposes, after which we will take reasonable steps to ensure that your personal data is destroyed or deleted if it is no longer necessary, unless its retention is required to satisfy legal, regulatory or accounting requirements or to protect our interests.

The saliva or buccal sample will be securely disposed of within thirty (30) days following the completion of the analysis.

Your Rights

You have the following rights in relation to your personal data:

  1. You may correct or update your personal data by contacting our customer service;
  2. You may request access to the personal data that is being processed by us and retained in our records;
  3. You may request us to cease sending you information regarding new or promotional products, services, or initiatives; and
  4. You may withdraw, in full or in part, your consent previously given to us for the processing of your personal data. Please note, however, that the withdrawal of consent may result in us being unable to continue providing certain products or services to you, and we shall not be held liable for any loss or damage arising as a result of such withdrawal.

Pengenalan

Dami Strategies Sdn Bhd (termasuk syarikat bersekutunya, secara kolektif dirujuk sebagai “kami”) mengiktiraf tanggungjawab kami dalam pengumpulan, penggunaan, perkongsian, pendedahan, pemprosesan dan penyimpanan data peribadi selaras dengan Akta Perlindungan Data Peribadi 2010 (“PDPA 2010”) serta peraturan dan garis panduan yang berkenaan.

Notis ini menjelaskan bagaimana kami memproses data peribadi anda bermula daripada pengumpulan, penggunaan, perkongsian, pelupusan sehingga langkah-langkah keselamatan yang kami wujudkan untuk memastikan data peribadi anda dilindungi dengan sewajarnya.

Pengumpulan Data Peribadi

Kami boleh mengumpul maklumat peribadi berikut daripada anda, termasuk tetapi tidak terhad kepada:

  1. maklumat profil anda dan/atau anak anda seperti nama, jantina, bangsa, umur, tarikh lahir, alamat e-mel, nombor telefon mudah alih, alamat kediaman, berat, tinggi, nama sekolah, tahap pendidikan, pekerjaan, bilangan anak;
  2. sampel biologi anak anda, yang dikumpul melalui air liur atau calitan pipi serta maklumat genetik yang dijana melalui pemprosesan sampel DNA tersebut oleh kami atau penyedia perkhidmatan kami;
  3. maklumat kesihatan fizikal atau mental anda dan/atau anak anda yang didedahkan secara sukarela atau dikumpul berkaitan penggunaan Perkhidmatan kami (seperti yang ditakrifkan di bawah);
  4. maklumat kewangan anda seperti akaun bank atau butiran kad debit/kredit;
  5. maklumat yang dirakam melalui CCTV atau sistem pengawasan lain apabila anda berada di premis kami;
  6. maklumat berkaitan nama pengguna dan kata laluan akaun anda di Laman Web kami;
  7. maklumat berkaitan pertanyaan, maklum balas, atau interaksi dengan kakitangan kami, termasuk rekod panggilan, e-mel atau komunikasi lain;
  8. sebarang maklumat lain yang anda berikan kepada kami atau yang perlu/relevan bagi tujuan yang dinyatakan di bawah.
Jika data peribadi tersebut berkaitan dengan kanak-kanak di bawah umur lapan belas (18) tahun, anda dengan ini mengesahkan bahawa anda adalah ibu bapa atau penjaga sah yang mempunyai kuasa untuk memberikan keizinan bagi pihak kanak-kanak tersebut.

Dengan menyerahkan maklumat peribadi anda kepada kami termasuk maklumat yang dinyatakan di atas, anda dengan ini memberi persetujuan kepada pengumpulan dan pemprosesan data peribadi anda oleh kami.

Dengan memberikan persetujuan anda, anda juga memberi persetujuan nyata kepada kami untuk memproses data peribadi sensitif seperti maklumat berkaitan kesihatan fizikal atau mental anda dan/atau anak anda bagi tujuan seperti yang diterangkan dalam Notis ini atau sebagaimana yang dikehendaki oleh undang-undang.

Dengan memberikan maklumat berkaitan pihak ketiga (jika ada), anda mengesahkan bahawa anda telah memperoleh persetujuan sah daripada pihak ketiga tersebut bagi membolehkan kami mengumpul dan memproses data peribadinya.

Sumber Pengumpulan Data Peribadi

Kami mengumpul data peribadi secara langsung daripada anda dan/atau melalui cara berikut:

  1. apabila anda melayari laman web kami https://neucleuseducation.com/ (“Laman Web”);
  2. apabila anda memberikan atau mengemas kini maklumat anda dengan kami, termasuk melalui borang pertanyaan dan borang dalam talian lain di Laman Web;
  3. apabila anda berinteraksi dengan kami secara langsung atau tidak langsung melalui saluran komunikasi termasuk panggilan telefon, surat, mesyuarat fizikal atau maya, e-mel, platform media sosial, atau Laman Web;
  4. apabila anda menyertai atau memberi maklum balas kepada acara, tinjauan atau aktiviti interaktif kami sama ada maya atau fizikal;
  5. apabila anda menggunakan Perkhidmatan kami termasuk ujian DNA, program pembangunan kanak-kanak peribadi dan konsultasi keibubapaan (“Perkhidmatan”);
  6. apabila anda mengemukakan kepada kami sebarang borang, seperti borang pendaftaran, pengisytiharan atau borang berkaitan lain, sama ada dalam talian atau dalam bentuk fizikal, bagi tujuan termasuk tetapi tidak terhad kepada pemprosesan pertanyaan anda, pengurusan akaun anda, penambahbaikan Perkhidmatan kami, atau memudahkan akses anda kepada Perkhidmatan kami;
  7. apabila anda membuat pembayaran, melanggan Perkhidmatan atau mengemas kini maklumat bil/pembayaran anda;
  8. apabila anda melawat atau cuba mengakses premis kami dan imej/aktiviti anda dirakam melalui CCTV atau sistem keselamatan lain;
  9. apabila anda berurusan dengan kakitangan kami berkaitan akaun, Perkhidmatan atau urusan lain;
  10. apabila kami menerima data peribadi anda daripada sumber pihak ketiga termasuk rakan perniagaan, rakan kerjasama, wakil sah atau pihak lain yang berhak mendedahkan data tersebut kepada kami;
  11. apabila kami perlu mengumpul/memproses data anda untuk mematuhi undang-undang, peraturan atau dasar dalaman kami; dan/atau
  12. apabila data peribadi anda diperlukan bagi Tujuan (seperti yang ditakrifkan di bawah).

Tujuan Pengumpulan Data Peribadi

Data peribadi akan dikumpul, digunakan, dikongsi dan didedahkan bagi satu atau lebih tujuan berikut:

  1. mengesahkan identiti anda dan pendaftaran untuk Perkhidmatan;
  2. menyediakan akses dan penggunaan Perkhidmatan;
  3. memudahkan konsultasi atau pengaturan berkaitan yang diminta oleh anda;
  4. memproses transaksi pembayaran yang berkaitan dengan Perkhidmatan;
  5. berkomunikasi dengan anda mengenai akaun, penggunaan Perkhidmatan atau pertanyaan/maklum balas/permintaan;
  6. memaklumkan anda tentang pengumuman, promosi, acara atau kemas kini operasi kami;
  7. memastikan keselamatan dan kawalan akses ke premis, platform atau sistem Perkhidmatan;
  8. mematuhi semua keperluan undang-undang, statutori dan peraturan;
  9. tujuan berkaitan operasi, pentadbiran, pembangunan atau penambahbaikan Perkhidmatan; dan/atau
  10. semua tujuan lain yang berkaitan atau bersampingan dengan perkara di atas.

Pemprosesan Data Peribadi

Kami akan memproses data peribadi anda di Malaysia, Singapura dan Amerika Syarikat.

Pendedahan Data Peribadi

Kami boleh mendedahkan dan/atau menyediakan data peribadi anda kepada pihak berikut (dalam dan luar Malaysia) bagi tujuan yang dinyatakan di atas:

  1. penyedia perkhidmatan yang menyokong ujian DNA, analisis genotip atau pentadbiran Perkhidmatan, termasuk pengendali makmal pihak ketiga, penyedia pemprosesan/penyimpanan data dan penyedia sokongan IT;
  2. mana-mana individu yang terikat dengan kewajipan kerahsiaan;
  3. pihak berkuasa kerajaan atau badan kawal selia atau mahkamah di mana-mana bidang kuasa, atau mana-mana pihak ketiga yang membuat/mungkin membuat tuntutan; dan
  4. mana-mana pihak lain berhubung dengan Tujuan tersebut.

Langkah Keselamatan

Data peribadi anda akan disimpan selaras dengan PDPA 2010.

Kami akan mengambil langkah munasabah untuk melindungi data peribadi dalam simpanan/kawalan kami dengan melaksanakan langkah keselamatan yang sesuai bagi mencegah akses, pengumpulan, penggunaan, pendedahan, penyalinan, pengubahsuaian, pelupusan tanpa kebenaran atau risiko serupa. Walau bagaimanapun, kami tidak menjamin bahawa keselamatan data peribadi anda akan terjamin sepenuhnya dalam semua keadaan atau bahawa laman web kami bebas daripada kod berbahaya (contohnya virus, pepijat, trojan horse, spyware atau adware).

Anda juga bertanggungjawab untuk memastikan nama pengguna dan kata laluan anda selamat dan sulit serta tidak mendedahkannya kepada pihak tidak dibenarkan bagi mengurangkan risiko pelanggaran data.

Tempoh Penyimpanan Data Peribadi

Anda mengakui bahawa melainkan diminta secara bertulis, kami berhak untuk menyimpan data peribadi anda selama mana yang diperlukan untuk memenuhi Tujuan, selepas itu kami akan mengambil langkah munasabah untuk memusnahkan atau memadamkan data tersebut, kecuali jika penyimpanan diperlukan untuk mematuhi keperluan undang-undang, peraturan, perakaunan atau bagi melindungi kepentingan kami.

Sampel air liur atau calitan pipi akan dilupuskan dengan selamat dalam tempoh tiga puluh (30) hari selepas analisis selesai dijalankan.

Hak Anda

Anda mempunyai hak berikut berkaitan data peribadi anda:

  1. Membetulkan atau mengemas kini data peribadi dengan menghubungi perkhidmatan pelanggan kami;
  2. Meminta akses kepada data peribadi yang sedang diproses dan disimpan dalam rekod kami;
  3. Meminta kami berhenti menghantar maklumat berkaitan produk, perkhidmatan atau inisiatif baharu/promosi; dan
  4. Menarik balik, sepenuhnya atau sebahagiannya, persetujuan yang telah diberikan kepada kami sebelum ini untuk memproses data peribadi anda. Harap maklum bahawa penarikan balik persetujuan mungkin menyebabkan kami tidak dapat terus menyediakan produk atau perkhidmatan tertentu kepada anda, dan kami tidak akan bertanggungjawab terhadap sebarang kerugian atau kerosakan akibat penarikan balik tersebut.
